Which permits a new pool needs

A residential pool is reviewed by several trades. The exact list is local, so the City of Orlando’s published checklist and Houston’s fee schedule serve as worked examples below.

The City of Orlando says a typical residential swimming pool or spa requires a minimum of three permits: building, electrical and engineering, plus plumbing or gas if you add a gas heater or an automatic fill line (City of Orlando checklist). The engineering permit is generated by city staff during building review and carries its own fee. In Houston, residential pools also go through Health Department plan review, priced at $94.00 from January 1, 2026 (City of Houston fee schedule).

Zoning sets where the pool may go. Orlando requires the water’s edge to sit at least 5 feet from side and rear property lines, 15 feet from the street side of a corner lot, 10 feet behind the front facade and 10 feet horizontally from overhead utility lines (Orlando Sec. 58.958). Your HOA may add its own approval on top of the city’s pool permit.

The pool permit process, step by step

  1. Confirm local rules and setbacksCheck zoning, easements, utility lines and HOA covenants before design is final.
  2. Hire a licensed contractor where your state requires one14 of 51 jurisdictions issue a dedicated pool contractor license; 16 states leave licensing to cities and counties (PC&S licensing research).
  3. Submit plans and pay plan reviewSite plan, pool engineering, electrical bonding and barrier details go in one package. Plan review can be priced as a share of the permit fee: 80% in Phoenix for residential projects over $50,000.
  4. Permit issued, construction fencing upThe 2021 ISPSC requires construction fencing at least 4 feet high around an in-ground pool site from excavation until the permanent barrier is done.
  5. Pass staged inspectionsSteel, bonding, plumbing pressure, electrical and safety inspections happen before the pool is filled.
  6. Final inspection and barrier sign-offThe building final checks the barrier, gates and deck. Then the permit closes.

Timing within the year matters a little. Applications filed in December took 17% longer than a typical month across eight cities (an index of 117 for 2019 to 2023 applications). In 2026 so far, 6 of 11 jurisdictions are faster than in the same months of 2025; New Orleans cut its median from 38 to 19 days.

What a pool permit costs: fee formulas from city schedules

Most cities charge on declared project value, then add plan review, surcharges and trade permits. We applied two published formulas to the same $68,000 pool.

The $68,000 value is the middle city median of 2025 declared values for new in-ground pool permits in 10 jurisdictions (PC&S build cost research). In Phoenix, that value produces an $865 permit fee ($703 on the first $50,000 plus $9 per additional $1,000), a $692 plan review fee (80%) and a $30 aquatics surcharge: $1,587 in total (Phoenix fee schedule). Phoenix also sets a $234 minimum for any pool permit. In Orlando, the same value gives a $354.38 building fee and $391.59 after four surcharges totaling 10.5%, with a separate $50 electrical line for a swimming pool (Orlando fee schedule).

Real permit records land in the same range. New Orleans recorded a median $546 in fees on 2025 new residential pool permits, and Raleigh $392 (PC&S analysis of city data). Orlando prices construction at the ICC valuation table or the contract price, whichever is greater, so a higher contract raises the fee.

Pool inspections: one city's sequence from steel to final

Orlando publishes 15 inspection steps in its recommended order for a typical residential pool, 2 of them only when they apply (City of Orlando). It is a useful model for what inspectors look at anywhere.

Two details trip up projects: the steel and bonding inspections must pass before concrete covers them, and the safety inspection comes before water goes in. For the full build order, see the pool construction process.

Pool fence and barrier rules tied to the permit

Barrier rules are checked at final inspection. As of October 2026, 20 of 51 jurisdictions require a barrier around new residential pools statewide, 16 have partial rules and 15 leave it to local codes (PC&S pool fence law research). Of the 32 states with a statewide height rule, 30 set 48 inches; Arizona (ARS 36-1681) and California (HSC 115923) require 60 inches.

  • Height At least 48 inches above grade on the outside, measured along the whole perimeter (ISPSC 2021 Section 305.2.1).
  • Openings No gap that passes a 4-inch sphere.
  • Gates Self-closing, self-latching, opening outward from the pool; residential latch releases at least 54 inches high unless on the pool side.
  • Safety cover exception The model code waives the barrier for pools with a powered safety cover meeting ASTM F1346, but New Jersey and Maryland do not accept that swap.
  • Alarms Connecticut and New York also require a pool alarm for new residential pools.
  • California New or remodeled pools at single-family homes need at least 2 of 7 drowning prevention features when the permit is issued.

Who pulls the pool permit: contractor licensing and owner-builders

In most projects the licensed builder applies for the permit. Rules on who may build differ widely: 14 of 51 jurisdictions issue a dedicated pool contractor license, while 16 states, home to 37.7% of US residents, leave it to cities and counties (PC&S licensing research). Alabama exempted residential pool construction from its general contractor license on October 1, 2026 (Alabama board notice). California had 2,831 active C-53 swimming pool licenses on October 5, 2026.

Owner-builder permits exist but carry obligations. Florida lets owners act as their own contractor on a home they occupy, but the owner must personally appear and sign the permit application, and selling or leasing within 1 year of completion is treated as evidence the work was done for sale (Fla. Stat. 489.103(7)). Before hiring, read how to choose a pool builder and our pool planning checklist.

Construction fencing at least 4 feet high is required from excavation until the permanent barrier is complete under the 2021 ISPSC.
Construction fencing at least 4 feet high is required from excavation until the permanent barrier is complete under the 2021 ISPSC.

Public pool rules and building without a permit

Pools at HOAs, apartments and hotels count as public pools under the model code and face extra rules. The federal Virginia Graeme Baker Pool and Spa Safety Act, signed December 19, 2007 and effective December 19, 2008, set drain entrapment requirements for public pools and spas (CPSC PoolSafely). Commercial projects are covered on our commercial pool construction page.

Skipping the permit costs more later. Orlando adds a penalty of 100% of the applicable permit fee for work without a permit and charges 25% of the original fee, up to $1,000, to renew an expired permit (Orlando fee schedule). An open or missing permit can also come up when you sell the house.

Frequently Asked Questions

Do I need a permit to install a pool in my backyard?

For an in-ground pool, plan on it. Orlando, for example, requires at least three permits for a typical residential pool or spa: building, electrical and engineering (City of Orlando). Rules for small or portable pools vary by city, so ask your building department.

What happens if you put a pool up without a permit?

Cities can stop work and charge penalties. Orlando adds 100% of the applicable permit fee for work without a permit (Orlando fee schedule). An open or missing permit can also come up when you sell.

How long does it take to get a pool permit?

In 2025 the median ran from 1 day in San Antonio to 70 days in Austin across 12 jurisdictions; the middle of eight long-run cities was 38.5 days (PC&S research).

How long does it take to get a pool permit in Florida?

Florida law sets 30 business days for a complete residential application under 7,500 square feet, with a 10% fee reduction per business day of delay (Fla. Stat. 553.792). Observed 2025 medians were 42 calendar days in Orlando and 59 in Cape Coral.

How much is a pool permit?

It follows the city’s formula. For a $68,000 pool, Phoenix’s 2026 schedule gives $1,587 including plan review and its aquatics surcharge, and Orlando’s gives $391.59 for the building permit with surcharges. Recorded 2025 medians were $546 in New Orleans and $392 in Raleigh.

How much is a pool permit in Florida?

In Orlando the building permit fee is $64.94 for the first $1,000 of construction cost plus $4.32 per additional $1,000, plus surcharges of 10.5% and a $50 electrical pool line (Orlando fee schedule). Other Florida cities set their own schedules.

Who pulls the pool permit, me or the builder?

Usually the licensed builder. In Florida an owner can pull an owner-builder permit only by appearing in person to sign the application and accepting the obligations in the statutory disclosure.

Do I need a separate electrical permit for a pool?

In many cities, yes. Orlando lists electrical as one of the three minimum permits and inspects pool steel bonding, underground conduit, deck bonding and a pre-fill electrical safety check (NEC Article 680).

What inspections does a new pool need?

Orlando’s sequence runs from an engineering pre-walk through steel, bonding, underground electrical, deck and piping pressure (35 psi), a safety inspection before filling, and electrical, engineering, zoning and building finals: 15 steps, 2 of them conditional.

What fence does a pool permit require?

Most statewide rules follow the model code: a barrier at least 48 inches high with no opening that passes a 4-inch sphere and self-closing, self-latching gates. Arizona and California require 60 inches (PC&S research).

Can I get a pool permit as an owner-builder?

Some states allow it. Florida’s owner-builder exemption covers a home you occupy, requires you to sign the permit in person, and treats a sale or lease within 1 year as evidence of building for sale (Fla. Stat. 489.103).
